High Court Nullifies Establishment of 21 Presidential Advisory Positions.
The High Court has struck out the establishment and staffing of 21 advisory roles attached to the Presidency, finding that the manner in which the offices were created breached constitutional requirements.
Justice Bahati Mwamuye ruled that the decisions leading to the formation of the advisory positions and the subsequent appointment of individuals to occupy them were not supported by law.
The court held that the actions of the officials involved lacked a proper legal foundation, rendering the appointments invalid.
As a consequence, the court issued orders overturning both the creation of the offices and the appointments themselves, effectively removing all 21 advisers from office.
The judgment also barred any further processing or release of public funds in the form of salaries, allowances or benefits to the advisers.
Beyond the specific appointments, the court ordered an extensive review of all offices established during the same period to determine whether they meet constitutional standards, statutory provisions, and public service rules.
The responsible authorities were directed to complete the audit and present a progress report to the court within 120 days.
