Embakasi North MP Hon. James Mwangi Gakuya has demanded a public apology, retraction, and removal of content following alleged defamatory statements made during a live broadcast on The Obinna Show.
Legal notice issued
In a legal notice issued through Mabeya & Mabeya Advocates, the MP argues that the statements allegedly published on April 23, 2026 portrayed him in a defamatory light, linking him to claims of involvement in organised violence, destruction of property, and mobilisation of groups during public demonstrations.
Meaning and interpretation of statements
The notice states that, in their natural and ordinary meaning, the words were understood to suggest that the MP is a criminal actor, morally unfit for public office, and engaged in unlawful conduct ,allegations he strongly denies.
Claim of reputational damage
The lawyers further maintain that the statements have caused serious reputational harm to their client, who insists he had no involvement in the activities referenced.
The notice states:
“These imputations are gravely defamatory and actionable per se, and have caused and continue to cause substantial and irreparable damage to our Client’s reputation, standing, dignity and credibility as a public leader.”
It further adds:
“The said pronouncements are utterly nonsensical, absurd, false, scandalous, defamatory, reckless, malicious, inimical and wholly devoid of any factual or evidentiary foundation.”
Demands issued
Among the demands issued include an immediate public apology and retraction, cessation of any further publication of the alleged defamatory content, and the complete removal and permanent takedown of the material from all platforms, including YouTube and social media.
Two-hour ultimatum and legal warning
The notice also sets strict compliance terms, stating that the demands must be met within TWO (2) HOURS from the time of receipt, time being of the essence.
It further warns that failure to comply will result in legal action being instituted without further reference.
Reference to broadcast remarks
During the same broadcast on The Obinna Show, Majority Leader Kimani Ichung’wah was also quoted making remarks relating to Embakasi MPs and issues discussed during the interview.
