Seven to Be Charged Over Ksh348 Million Homa Bay Assembly Construction Deal.

Seven individuals, including former senior officials of the Homa Bay County Government and a private company, are set to face criminal charges following investigations into alleged irregularities surrounding a multimillion-shilling construction tender.

The case centres on the procurement of a contract for the construction of the Homa Bay County Assembly offices, valued at approximately Ksh348.9 million, which investigators say was awarded through a flawed and unlawful process.

Among those named are Odhiambo Daniel Kaudo, the former Clerk of the County Assembly, and Faith Adhiambo Apuko, who previously served as Acting Clerk.

Also listed are Patrick Tunoi, a senior quantity surveyor attached to the State Department of Public Works, and James Mumali Oyuka, a director at Hartland Enterprises Limited, the firm that won the tender.

Investigators further identified Mary Pauline Oduor, a principal nurse at Homa Bay Referral Hospital and director of the same company, and Roseline Anyango Odhiambo, a former County Executive Committee member for Lands, as persons of interest in the transaction.

Hartland Enterprises Limited itself will also be charged.

According to the investigation file, the tender—identified as HBCA/T/W6/2018–2019—was allegedly awarded to a company linked to county employees, raising concerns of conflict of interest, abuse of office and breach of procurement regulations.

The suspects are expected to answer to charges including abuse of office, deliberate violation of procurement laws, conflict of interest, and unlawful acquisition of public property under the Anti-Corruption and Economic Crimes Act.

The matter will proceed to court once arraignment dates are scheduled.
