Court Declines to Close File in KCB Refund Dispute Amid Contested Payment Claims.
A Nairobi court has declined to mark as settled a civil case involving Kenya Commercial Bank (KCB) after the plaintiff challenged claims that the disputed funds had been refunded.
The matter, Everlyne Mwenda Karisa vs Kenya Commercial Bank, came up before Senior Principal Magistrate Lucy Njora for mention, with the respondent indicating that the issue had been resolved and seeking closure of the file.
However, counsel for the plaintiff opposed the request, arguing that the alleged refund had not been supported by any documentary evidence before the court.
The plaintiff maintains that a total of Ksh 779,603 remains outstanding, while the respondent claims to have refunded Ksh 413,728.
Counsel submitted that no proof had been presented to demonstrate that the funds were credited to the plaintiff’s account, insisting that the court could not confirm settlement in the absence of verifiable records.
In response, the bank relied on a reply dated January 27, 2026, maintaining that part of the amount had already been reimbursed.
Following the disagreement over the alleged payment, the court declined to close the matter and instead directed that the dispute be determined through written submissions.
Both parties were granted seven days each to file and exchange their submissions.
The court is scheduled to deliver its ruling on March 20, 2026, which will determine whether the alleged refund was properly effected and whether any balance remains payable.
