We have noted the recent public notice by Bank of Baroda (Kenya) Ltd cautioning the public against “unverified information” circulating online and on social media.
For avoidance of doubt, information being circulated concerning the court proceedings between Infinity Industrial Park Limited and Bank of Baroda (Kenya) Limited should be assessed against the official orders, rulings, decree and other records issued by the High Court of Kenya.
Infinity Industrial Park has no interest in circulating unverified information. Our public communications concerning the litigation are based on court documents and developments in proceedings before the High Court.
We therefore welcome verification.
Rather than relying on statements by either party, members of the public and media are encouraged to refer to the actual court record and independently establish what orders have been made and what matters remain pending before the Court.
Where proceedings remain pending—including the contempt proceedings—we equally recognise that those matters must be determined by the Court and should not be presented as already decided.
