When the case against Abdirahman Muhumed Abdi, also known as Abdi, appeared before Magistrate Geoffrey Onsarigo, the court was informed that the DPP wishes to withdraw the case.
The move was strongly opposed by the complainant, who said he is not aware of any attempt by the parties to try and withdraw the case.
In this case, Muhumed is charged with forgery and making a false document contrary to the law.
The court has been informed that on unknown dates and at an unknown place within the country, with the intent to defraud PANSIBA Limited of its land, LR No. 209/10848 and LR No. 209/10849, measuring approximately 0.8000 hectares, all valued at Sh 300,000,000.
He is said to have fraudulently amalgamated the two parcels, which gave rise to LR NO.209/16790, and forged a certificate of title for the said parcel of land, purporting it to be a genuine certificate of title for the said parcel of land, purporting it to be a genuine certificate of title issued by the Ministry of Lands and Physical Planning, knowing it was untrue.

Muhumed was charged in the second count with forging the said title deed and amalgamating the two lands, which gave rise to LR NO. 209/16791, and made a provisional approval dated APRIL 4, 2006, FROM THE MINISTRY OF LANDS purporting it to be a Certificate of Title issued by the Ministry of Lands and Physical Planning, knowing it was not true.
He was charged in the last count with making a false document contrary to the law.
The court was informed that Muhumed, with the intent to defraud PANSIBA of his land, fraudulently made a document known as P.P.A 2, issued by the City County of Nairobi, knowing it was untrue.
Muhumed, upon taking a plea, has since denied all the charges and is out on bail.
Due to that controversy about withdrawal, Magistrate Onsarigo directed the matter to be mentioned on August 8, 2025, when he will deliver a ruling on the same.
