Two Akasha Allies and Indian Businessmen have been charged in Kibera law court with the offences of threatening to kill and assault causing bodily harm.

Rahiel Daud Two Akasha Allies and Indian Businessmen have been charged in Kibera law court with the offences of threatening to kill and assault causing bodily harm.

Rahiel Daud who is the owner of and Hitesh Motwani alias Vicky who works with Executive Car World appeared before Kibera Senior Principal Magistrate Zainabu Abdul and denied the two counts presented before them.

The prosecution told the court that on March 25, 2026, at Taal Club in Westlands within Nairobi county, without lawful excuse threatened to kill Arya Anuj.

In the second count the court heard that at the aforementioned time the duo assaulted Arya Anuj occasioning bodily harm.

They denied the charges and through their lawyer requested to be released on lenient bond terms assuring the court to comply with the terms and conditions to be set by the court,

“Your honour we pray the release of the accused persons on lenient cash bail since they are not a flight risk,” the defence pleaded.

The prosecution did not oppose the release of the accused persons on bond but urged the court to consider the seriousness of the first count of threatening to kill. She also urged the court to consider the probation report before granting bond to know the relationship of the duo within the society.

Further, she prayed the court to issue an order for the accused not to leave the jurisdiction of the court.

The duo are also alleged to be involved in fraud and extortion business.

In determination, the magistrate directed the accused to be detained in Parklands Police Station until Monday March 30, 2026, awaiting the pre-bail report to determine the issue of bond.

The defence had earlier applied for the differment of the plea taking citing that the accused persons were forced to record their statements behind a building at Capital Hill Police Station and the need for the DPP to review the charges whether they meet prosecution threshold.

In giving directions on the issue, the magistrate stated that before a charge sheet is presented before the court, it comes from the Office of the DPP where it is drafted after reviewing the file from investigators considered worthwhile for the involved parties to answer to the respective charges.
