EABL sexual Assault Case Set for May 4 Mention as Court Orders Compliance.

The case involving Diageo PLC and JILK Construction Company Limited will now be mentioned on May 4, 2026, after a Nairobi court directed all parties to file and serve compliance documents before the matter proceeds further.

The dispute, before Chief Magistrate Geoffrey Onsarigo, stems from a construction contract between JILK and Kenya Breweries Limited (KBL) for a brewery project in Kisumu undertaken between 2016 and 2017.

JILK is seeking to privately prosecute two individuals, Brendan Daly and Nicholas Quarke, who were linked to the project under Diageo.

The two are accused of allegedly sexually harassing female employees during the course of the project.

Earlier proceedings revealed that East African Breweries Limited (EABL), a subsidiary of Diageo, had not been fully served with all court documents, an issue that contributed to delays in progressing the case.

The defence, led by lawyer Cecil Miller, has opposed the application for private prosecution, raising legal and procedural concerns.

The court will on May 4 determine whether all parties have complied with its directions, a step expected to shape how the matter proceeds.
