High Court Bars Robert Alai from Defaming Lawyer Danstan Omari in Ksh 100M Lawsuit.
The High Court passed an order barring Robert Alai, a blogger, from publishing any defamatory statements against Lawyer Danstan Omari, pending the hearing of a defamatory lawsuit filed by the lawyer.
Lady Justice Janet Mulwa granted the ruling on Thursday, siding with Omari’s plea of reputational harm caused by publications made by the blogger.The ruling prevents posting or republishing defamatory content by the blogger or anyone else acting on his behalf.
Lawyer Danstan Omari alleges that on 10 June, 2025 Alai made a post on his facebook in which he referred to the lawyer as a “joker”, a “pig” and “mjinga” (fool)
In the ruling, the court directed that the costs for the suit would be determined upon the completion of the main hearing. The case is scheduled to continue for pre-trial directions March 4, 2026.
This decision by the court roots from a heated exchange between the two parties last year.The legal representation of Omari, Wambui Shadrack & Associates, had demanded Ksh 100 million, a public apology, and a retraction of the publication by Alai.
Mr Alai however responded with a defiant letter dismissing the demand and labelling it a ” clown show “in an attempt to protect the lawyer’s ego. He further defended his publication as a fair comment on a public interest matter.
In his lawsuit Lawyer Omari seeks a permanent ban on defamatory statements by the blogger,a mandatory order for Mr Alai to delete the post and publish a follow-up refraction, Ksh 100 million as compensation for damages and ghat the costs of the lawsuit to be covered.
