Infinity Industrial Park Limited has lodged a formal complaint with the Official Receiver seeking an investigation and possible disciplinary action against two former joint administrators appointed to oversee the company.
The complaint concerns Ponangipalli Venkata Ramana Rao, identified as I.P. No. OR/IP/001, and Swaroop Rao Ponangipalli, identified as I.P. No. OR/IP/032.
Complaint Follows Court Ruling
According to the complaint, the dispute arose from the appointment of the two practitioners by Bank of Baroda (Kenya) Limited on August 10, 2026, and their subsequent assumption of control over Infinity Industrial Park.
Infinity says the appointments were made despite ongoing court proceedings and a regular default judgment whose setting-aside application had been dismissed by the High Court on July 31, 2026.
The company says the matter subsequently moved beyond a commercial dispute following a ruling delivered on September 24, 2026, in High Court Insolvency Cause No. HCCOMMIN/E132/2026, involving Bank of Baroda (Kenya) Limited and Infinity Industrial Park Limited.
Court Orders Cited in Complaint
Infinity says the High Court set aside, annulled and terminated the appointment of the former joint administrators.
According to the complaint, the court also held that the administration constituted an “improper appointment” and involved the collateral invocation of statutory insolvency powers that was inconsistent with the Insolvency Act.
The company further states that the court directed the former joint administrators to return Infinity’s property.
The court also directed the Registrar of Companies, the Official Receiver and other relevant authorities to rectify or cancel entries showing Infinity as being under administration, according to the complaint.
Infinity says the court additionally granted a permanent injunction restoring the company’s management and control.
Request for Disciplinary Action
Following those orders, Infinity has asked the Official Receiver to commence a formal investigation into the conduct of the two insolvency practitioners.
The company wants the investigation to determine whether the practitioners remain fit and proper persons to hold authorisations as insolvency practitioners.
It has also requested that the Official Receiver consider disciplinary proceedings against them.
The complaint has been made to the Official Receiver in the Office of the Official Receiver in Insolvency at the Business Registration Service.
The document is headed “Formal Complaint and Request for Investigation, Disciplinary Proceedings and Revocation/Cancellation of the Authorisations of the Former Joint Administrators of Infinity Industrial Park Limited.”
The complaint was received by the Business Registration Service’s Office of the Official Receiver on October 1, 2026, according to the receiving stamp on the document.
