Michael Moragia Nyachae, the son of former Cabinet Minister Simeon Nyachae, has appeared in court to answer a theft charge involving Ksh1,226,036 allegedly belonging to Sansora Group Limited.

Nyachae was accused of taking the money on various dates between March 28, 2019, and September 28, 2021, in Kisii County.

The prosecution has charged him under Section 268(1) read together with Section 275 of the Penal Code, with Sansora Group Limited listed as the complainant in the case.

When the matter came before Magistrate Caroline Nyaguthie, Nyachae denied the allegation and entered a plea of not guilty.

His defence moved to have him released on bail, asking the court to exercise its discretion while considering the circumstances of the case.

The lawyers pointed out that Nyachae comes from a prominent family and argued that the circumstances surrounding the charge warranted favourable bail terms.

They also sought to put the dispute into context, telling the court that the company named in the charge sheet is a family company.

The defence described the matter as a case of “smoke without fire” as they urged the court not to impose stringent conditions on their client.

The court granted Nyachae a bond of Ksh200,000 or an alternative option of Ksh50,000 cash bail.

The case has been scheduled for mention on September 29, when the court will give pre-trial directions.
