Rebecca Njeri Muraya and Abdisalam Ahmed face serious allegations after a woman, Ayni Hussein Mahammud, accuses them of police brutality. The case has taken a dramatic twist as Mahammud alleges that a Nairobi prosecutor is tampering with justice. The letter in our possession is dated April 22, 2025, and is addressed to the Commission Secretary/CEO of the Commission on Administrative Justice at the Office of the Ombudsman.

She claims that state counsel Norah Atieno, who is the state counsel handling criminal case No. EO17/2025 at Milimani Court number 1, is conflicting and dangerous to her case.

“Regrettably, the conduct of the prosecutor raises serious concerns regarding bias, conflict of interest, and professional misconduct.

I am the victim in the case, and an incident stemming from December 31, 2021, raises serious concerns. The plea in my case has been deferred twice on previous days, each time by 30 days without a reasonable explanation.

These delays have caused undue psychological distress and impeded the administration of justice,” read the letter in parts.

She said that she tried to raise the issue with the Nairobi Regional ODPP, Mrs. Dorcus Rugut, who declined to assist him and directed the matter back to Norah Atieno, who also refused to listen and directed him to complain to the ODPP headquarters.

“Mrs Atieno falsely claimed that I had reported this case to multiple institutions. This is an incorrect and misleading statement for clarity,” he said.

She said that she struggled getting justice from the IPOA, and since the state counsel is tampering with his case, she wants serious investigations done into the conduct of her behaviour and close monitoring of the case to enhance transparency.

In the case of the two police officers, Rebecca Njeri Muraya, who was the Officer Commanding Station (OCS) for Eastleigh North Police Station, was charged together with her colleague, Sergeant Abdisalam Ahmed, before Milimani Chief Magistrate Lucas Onyina.

The Independent Policing Oversight Authority (IPOA) investigated the matter four years ago and sent the findings to the Office of the Director of Public Prosecutions, recommending the prosecution of the two officers.

According to her letter, the officers had initially succeeded in deferring the plea, but on May 5, 2025, they will come for mention.

They had so far denied torturing Ayni Hussein Mahammud by locking her up at Muthaiga Police Station for two days beginning December 31, 2021.

When the matter came up to be mentioned before the same court, the court directed that it proceed on May 5 for further directions
