JUSTICE AND EQUITY COUNCIL KENYA FLAGS IRREGULARITIES IN eCITIZEN PLATFORM FINANCES.

The Justice and Equity Council Kenya (UK Chapter), led by Chairman Sebastian Ochieng Onyango, has formally initiated enforcement action after submitting detailed complaints to the Ethics and Anti-Corruption Commission (EACC) and the Kenya Revenue Authority (KRA).

The Council says the action is based on audit findings and publicly documented financial patterns that raise serious concerns over possible financial impropriety, unlawful enrichment, and economic crimes.

eCitizen Platform:Financial Irregularities Under Scrutiny

In its complaint to the EACC, the Council cites findings attributed to the Auditor-General that point to several concerns surrounding the eCitizen platform.

Among them are approximately KSh 2.57 billion reported as unaccounted for, alleged diversion of public funds through irregular channels.

Payments made outside approved contractual frameworks, and governance weaknesses that may have enabled misuse of public resources are also included.

The Council says that, if confirmed, these issues could amount to violations of the 2010 Constitution of Kenya, the Anti-Corruption and Economic Crimes Act, and the Public Finance Management Act.

Public Donations ,Tax and Source of Funds Review

In a separate submission to the Kenya Revenue Authority, the Council is seeking a forensic review into the source, legality, and tax treatment of public donations and fundraising activities.

It has raised questions over whether the funds were lawfully acquired and properly declared, whether all tax obligations were met, and whether any of the financial flows could constitute unexplained wealth or proceeds of crime.

Council Position

The Council maintains that no individual or institution is above the law and that public resources must be managed transparently and in accordance with the Constitution.

It adds that any unlawful enrichment should be fully investigated and, where established, prosecuted and recovered.

Conclusion

The Council says its action is not politically motivated, but is instead aimed at promoting accountability and protecting the public interest.

It is calling on the relevant authorities to act independently, promptly, and in accordance with the law.
