CS Miano in Trouble as Court Sets a Mention Date for a Petition Against her.

The Court has refused to grant urgency in a petition challenging Tourism Cabinet Secretary Rebecca Miano against her involvement in the Ol Kalou parliamentary by-election campaigns.

Lady Justice Lilian Mutende ordered the application to be served to the respondents and interested parties within 14 days for it to be called at the Presiding Judge in Ol Kalou for further directions on 3 August 2026.

Activist Francis Awino filed the petition by Certificate of Urgency on 21 July 2026 against the violation of section 7 of the Constitution in Chapter Six, which deals with Leadership and Integrity.

Awino argues the Cabinet Secretary was very active in partisan politics in Ol Kalou, funded by the state’s money and security.

Awino in his supporting affidavit noted that “the involvement of a serving Cabinet Secretary in partisan political activities is a clear violation of the constitution of Kenya which expects State officers to act with neutrality, objectivity and accountability.

The petitioner is asking for the orders to prohibit CS Miano from engaging in any political activities while on Cabinet Secretary’s service and to make the Ethics and Anti-Corruption Commission (EACC) investigate her actions.

The respondents in the case include Hon. Rebecca Miano and the Attorney General, with the Independent Electoral and Boundaries Commission (IEBC) and the EACC listed as interested parties.

The Ol Kalou seat was left vacant after long serving MP David Njuguna Kiaraho died in March 2026. In the by-election, the Democratic for the Citizens Party (DCP) contender Sammy Kamau Ngotho polled 35,440 votes with United Democratic Alliance (UDA) contender Samuel Muchina Nyagah getting 5,450 votes.
