ODM Urges Tribunal to Throw Out Sifuna Complaint

The Orange Democratic Movement has asked the Political Parties Disputes Tribunal to dismiss Nairobi Senator Edwin Sifuna’s complaint, saying the party’s internal disciplinary process must run its course first.

The dispute stems from an NEC resolution on February 11, 2026, that removed Sifuna without a hearing.

Senior Counsel Okero, for Sifuna, argued that ODM breached Article 74 of its constitution and the Fair Administrative Actions Act by removing the complainant without according him a hearing.

Lawyer Ken Amondi for the ODM said the tribunal should not intervene because the issue is a disciplinary matter already before an ODM panel. She termed the complaint premature.

Sam Makori, also for the first respondent, said PPDT’s intervention amounts to overreach. He urged the tribunal to allow ODM to exhaust internal mechanisms.

TJ Kajwang, for the second respondent, submitted that the tribunal must give political parties room to handle disciplinary matters so they can grow as institutions.

Elizabeth Ndwiga appeared for the second respondent.

ODM prayed for the complaint to be dismissed.

Judgment is set for June 18, 2026.
