PPDT Declines to Stop Edwin Sifuna’s Removal as Fresh Challenge Set for Hearing.

The Political Parties Disputes Tribunal (PPDT) has declined to issue interim orders sought by former ODM Secretary General Edwin Sifuna to temporarily stop the Registrar of Political Parties from gazetting his removal from office, allowing the process arising from the party’s National Executive Committee (NEC) resolution of June 22, 2026, to proceed.

The Tribunal, however, directed that Sifuna’s fresh application challenging his removal be heard on July 21, 2026, when the parties will argue the matter on its merits.

Sifuna has moved back to the Tribunal claiming that the ODM Disciplinary Panel was biased and that the disciplinary process leading to his removal did not accord him a fair hearing.

Appearing for ODM, advocate Ken Amondi, alongside Simeon Mongare and T.J. Kajwang, opposed the application and maintained that Sifuna had been given every opportunity to participate in the disciplinary proceedings but chose not to.

Amondi told the Tribunal that “the disciplinary process was open, transparent and fair, but the complainant elected not to participate despite being given the opportunity.”

The lawyer further argued that the Tribunal lacked jurisdiction to grant the orders sought because the party had already implemented the NEC resolution and forwarded it to the Registrar of Political Parties.

“The decision of the National Executive Committee has already been implemented and transmitted to the Registrar of Political Parties. Once that statutory process commenced, the matter moved beyond the party and the Tribunal cannot issue orders to reverse or halt it,” Amondi submitted.

He also urged the Tribunal to decline the interim application, arguing that “there is nothing left for the party to implement because the resolution has already been acted upon. The Registrar is now undertaking a statutory mandate independent of the ODM Party.”

After considering the parties’ submissions, the Tribunal declined to grant the interim orders sought by Sifuna, leaving the Registrar free to continue processing the changes while the substantive dispute remains pending.

The matter was heard before a five-member bench comprising Presiding Member Gathu Kiragu, Jin Muzna Mohamed Yusuf, Stephen Musau, Theresa Chepkwony, and Abdirahman Adan Abdikadir. The Tribunal scheduled the fresh application for hearing on July 21, 2026.
