Lawyer Rose Mbithe and Son Break Silence in Dr Mutiso Murder Case

Lawyer and politician Rose Mbithe and her son, advocate Chris Mulwa, have broken their silence in court over the murder case involving Dr Victoria Nthunya Mutiso, making a series of allegations about their family, the investigation and the circumstances surrounding their arrest.

Mbithe, who is accused alongside her children in the case, used her address to the court to describe her longstanding relationship with her former husband and Dr Mutiso, who she claimed had once worked as a cleaner at her office.

“So the woman they are talking about, she was my cleaner in my office,” Mbithe told the court.

She further claimed that she had played a major role in supporting her former husband’s education, saying he was a second year medical student when their relationship began.

Mbithe also spoke about her four children, saying she had single handedly supported their education, with three becoming advocates and another pursuing information technology.

“I educated my four children: three advocates, one IT computer,” she said.

The lawyer-politician further claimed that her former husband is now wheelchair-bound and unable to appear, while alleging that a lawyer she identified as “Limo” had been given control over aspects of the family’s finances and property.

She alleged that the family had been cut off from their money and that their property could be disposed of while she and her children remained in custody.

“They have locked us in so that when we are in, with my daughter and my son because we are the ones who are head, they can sell our properties,” she told the court.

Mbithe strongly denied any involvement in Dr Mutiso’s death, portraying herself as a victim of circumstances.

“I want to tell the whole of Kenya, I’m a victim of circumstances. I’ve not killed anybody and I’ve done nothing,” she said.

Her son, Chris Mulwa, also addressed the court, alleging that the State had been “weaponized” against him and his family.

Mulwa claimed his identification documents, advocate’s card and items he needed for medical treatment had been confiscated. He further alleged that he was pressured to record a statement despite exercising his constitutional right to remain silent.

“I believe the state has been weaponized to maliciously prosecute us,” Mulwa told the court.

He also alleged that investigators threatened him with additional charges if he refused to cooperate, claims that were challenged by opposing counsel.

The lawyer representing the prosecution objected to the allegations, arguing that Mulwa, as an advocate, understood that serious accusations could not simply be made from the bar without being properly presented before the court.

The court subsequently intervened and directed the proceedings as the accused continued giving their accounts.

Mbithe and Mulwa’s statements provide their most detailed public account yet of how they view the case, with both maintaining their innocence as the murder proceedings continue.
