PATRICK KATUA MUTINDA GRANTED KSH 700,000 BOND IN KDF RECRUITMENT FRAUD CASE

Patrick Katua Mutinda has been released on a KSh 700,000 bond with a surety and a cash bail of KSh 400,000 after he denied charges linked to alleged KDF recruitment fraud.

The matter came up after a miscellaneous file before Court No. 8 involving Thamara Irene was marked as closed, allowing the court to proceed with plea taking in the main case.

Only Mutinda was in court when he took plea and denied the charges of obtaining money by false pretences.

According to the charge sheet, the two are accused of obtaining KSh 4,265,000 from Nicholas Wambua Muthangya and Anthony Muthui Muthangya between 6th November 2025 and 23rd December 2025 in Nzola, Mumbua area within Muthangya.

The court heard that the duo allegedly claimed they could secure recruitment slots for village mates in the Kenya Defence Forces (KDF), a representation the prosecution says they knew was false.

BOND APPLICATION

Through his lawyer, Mutinda asked the court to release him on favourable bond terms, saying part of the money had already been refunded. Counsel added that the accused and the complainant were still in communication over the remaining balance, even as late as the previous evening.

The defence maintained that Mutinda is a businessman based in Ngara and is not a flight risk. It was also told to the court that he was arrested in Mombasa while on business and fully cooperated with officers.

Lawyers further said the accused and complainants know each other and come from the same area, describing their relationship as one of prior acquaintance.

The prosecution, led by the Directorate of Criminal Investigations (DCI) and the Office of the Director of Public Prosecutions (ODPP), did not oppose bond but asked that the matter be mentioned within a week for pre-trial directions.

The court also sought to know how soon the dispute could be resolved. In response, defence counsel indicated that the outstanding amount could be cleared within about three months.

After hearing both sides, the court released Mutinda on a KSh 700,000 bond with one surety and set cash bail at KSh 400,000.

The matter will be mentioned for pre-trial on 28th April before Court No. 4.

Witnesses lined up in the case include Nicholas Wambua Muthangya, Anthony Muthui Muthangya, and Cpl Miruka Onyango.
