Petition Seeking Removal of KURA Director General Silus Kinoti Set for Hearing Tomorrow.

A petition seeking the removal of Kenya Urban Roads Authority (KURA) Director General Silus Kinoti from office is scheduled for hearing tomorrow before the Employment and Labour Relations Court in Nairobi.

The matter comes after the High Court directed that all respondents and interested parties be served with the petition and responses filed ahead of an inter partes hearing set for June 16, 2026.

The case was filed by Masha Wario against the Public Service Commission and the Kenya Urban Roads Authority Board, with Silus Kinoti named as an interested party and the Ethics and Anti-Corruption Commission (EACC) listed as an interested party in the proceedings.

In the petition, Wario argues that Kinoti’s continued occupation of the office of Director General is unconstitutional and unlawful, alleging that his tenure has exceeded the period permitted under the applicable legal framework. The petitioner contends that despite the expiry of the tenure, Kinoti has continued exercising executive authority, including signing contracts, approving projects and issuing administrative directives.

“The petition raises serious constitutional questions concerning continued occupation and exercise of authority in public office beyond the applicable tenure framework,” the petitioner states in court documents.

According to the petition, the office of Director General of KURA is a senior public office entrusted with significant responsibility over public resources and infrastructure development, making adherence to constitutional and statutory requirements critical.

Among the orders sought, the petitioner wants the court to declare that Kinoti’s continued stay in office is unconstitutional, null and void, prohibit him from exercising further authority as Director General and compel relevant state agencies to remove him from the position.

The petitioner further argues that allowing a public officer to continue serving beyond a lawful tenure period undermines constitutional principles of leadership, accountability, public trust and good governance.

Justice Jemimah Wanza Keli previously directed that the application be served for response and fixed the matter for hearing on June 16, 2026.

The case is expected to come up for hearing tomorrow.
