The Office of the Director of Public Prosecutions (ODPP) has approved criminal charges against a prosecutor stationed at the Makadara Law Courts in Nairobi over alleged bribery.

In a press statement issued on March 4, 2026, the Director of Public Prosecutions confirmed that Samuel Mugo Kiairie will face charges following investigations into bribery allegations against him.

According to the statement, the decision was made after the DPP reviewed an inquiry file submitted by the Ethics and Anti-Corruption Commission (EACC).

“The Director of Public Prosecutions (DPP) has reviewed an inquiry file forwarded by the Ethics and Anti-Corruption Commission (EACC) regarding bribery allegations against Mr. Samuel Mugo Kiairie, a prosecutor stationed at the Makadara Law Courts in Nairobi,” the statement reads.

The ODPP said that an independent evaluation of the evidence established that there is sufficient and credible evidence to support criminal prosecution.

“Upon an independent evaluation of the evidence presented, the DPP has established that there is sufficient and credible evidence to sustain criminal charges against Mr. Kiairie,” the statement said.

Consequently, the DPP has approved three counts of receiving a bribe contrary to Section 6(1) as read with Section 18 of the Bribery Act and directed that Kiairie be arraigned before a court of competent jurisdiction to answer to the charges.

The ODPP emphasized that the action demonstrates the office’s commitment to upholding integrity within the criminal justice system.

“The DPP reiterates that no individual, regardless of office, rank or position, is above the law and the Office of the Director of Public Prosecutions will not hesitate to take decisive action against any officer who undermines the integrity of the Criminal Justice System,” the statement added.

The ODPP further affirmed that it remains committed to executing its constitutional mandate in accordance with the rule of law, public interest and the proper administration of justice.
